1Introduction
These Terms and Conditions ("Terms") apply to all goods and services supplied by LASER FAB LIMITED trading as LaserFab (NZBN 9429053377210) ("LaserFab", "we", "us", "our") to any customer ("you", "the Customer").
Requesting a quote or submitting files does not place an order or authorise production. These Terms form part of an order when provided and agreed at acceptance. Updates do not retrospectively change an accepted order. Nothing in these Terms limits rights or remedies that cannot lawfully be excluded under the Consumer Guarantees Act 1993 or Fair Trading Act 1986.
2Quotes and Validity
All quotes issued by LaserFab are based on the drawings, files, and specifications provided at the time of quoting. Unless otherwise stated, quotes are valid for 30 days from the date of issue.
Quotes may be revised if the supplied files differ materially from those on which the quote was based, if material costs change prior to order acceptance, or if additional work is identified during production setup.
Dimensions on DXF, DWG, or other CAD files are taken at face value. LaserFab does not assume responsibility for errors or omissions in customer-supplied files.
3Orders and Acceptance
An order is accepted when LaserFab confirms acceptance in writing, including by email or through our online quoting system. LaserFab reserves the right to decline any order.
The Customer is responsible for verifying that all specifications, dimensions, quantities, and file versions are correct before confirming an order. Changes after acceptance may incur additional charges and affect lead times.
LaserFab may require payment or a deposit before commencing work on new accounts or high-value orders.
4Pricing, GST, and Payment
All prices are in New Zealand Dollars (NZD) and are exclusive of GST unless otherwise stated. GST will be added to invoices at the applicable rate.
Cash customers are required to pay in full prior to dispatch or collection. Trade account customers are subject to the payment terms agreed at account approval (7-day or 20th of the following month, as applicable).
LaserFab reserves the right to charge interest on overdue balances and to recover reasonable debt collection costs. Goods will not be released until outstanding amounts are settled.
5Customer-Supplied Files and Specifications
Customers are responsible for the accuracy and suitability of all files, drawings, and specifications they supply. LaserFab will manufacture to the supplied files and does not independently verify design intent, structural adequacy, or fitness for purpose.
Files should be supplied in DXF format (preferred), DWG, or another agreed format. LaserFab reserves the right to charge for file preparation or correction work required before production can begin.
Customer files are used for quoting and production and may be processed by our hosting, storage and other service providers as described in our Privacy Policy. Only send files you are authorised to provide. Retention is limited to legitimate business and legal needs.
6Materials, Tolerances, and Variations
Unless the Customer supplies material, LaserFab will source material in accordance with the agreed specification. Standard material grades and finishes will apply unless otherwise specified in writing.
Manufacturing tolerances will generally follow standard industry practice for laser cutting and CNC press braking unless tighter tolerances are specifically agreed in writing. LaserFab will advise if a requested tolerance is not achievable with the specified process.
Minor surface marking, heat-affected zones, and edge characteristics are inherent to the laser cutting and folding process and do not constitute a defect unless they fall outside agreed tolerances or specifications.
Underside finish. LaserFab does not guarantee the finish of the underside (the side resting on the machine bed) of laser-cut material. Sheet and plate supplied by material suppliers does not have a perfect underside, and the cutting process can cause marking, discolouration, or texture variation on this surface. If a specific underside finish is required for your application, this must be specified in writing before quoting. Additional processing to improve or protect the underside may incur extra charges.
7Lead Times, Collection, Delivery, and Risk
Lead times provided are estimates and are not guaranteed unless confirmed in writing. LaserFab will not be liable for delays caused by factors outside its reasonable control, including material supply issues, equipment maintenance, or third-party courier delays.
Collection and delivery arrangements will be confirmed with your order. Where LaserFab arranges delivery, our obligations under applicable consumer law continue during delivery. Please contact us if goods are damaged or missing in transit.
Delivery charges are additional unless included in the quoted price. Applicable freight costs will be advised at or before order confirmation.
8Inspection, Defects, and Claims
Please inspect goods on receipt and report defects, incorrect parts or shortages as soon as reasonably practicable. A delay in reporting does not remove statutory rights.
We will assess the cause of the issue, including the agreed specifications and any customer-supplied files. We remain responsible for obligations imposed by applicable law.
Remedies may include repair, replacement, refund or compensation as required by law. Where the law gives you a choice of remedy, that choice remains yours. See our Refunds, Returns & Cancellations policy.
9Cancellations, Changes, and Rework
Orders cannot be cancelled or modified after production has commenced without LaserFab's prior written agreement. Where cancellation is accepted, LaserFab reserves the right to invoice for agreed work completed and materials committed to that point. This does not restrict cancellation or refund rights provided by law.
Rework requests arising from errors in customer-supplied files will be charged at standard rates. Rework for manufacturing errors identified as LaserFab's responsibility will be completed at no additional charge.
10Limitation of Liability
To the maximum extent permitted by applicable law, LaserFab's total liability for any claim arising out of or in connection with the supply of goods or services is limited to the amount paid by the Customer for the specific goods or services to which the claim relates.
Subject to rights and remedies that cannot lawfully be excluded, LaserFab is not liable for any indirect, consequential, incidental, or special loss or damage, including loss of profit or business opportunity, whether arising in contract, tort, or otherwise.
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including under the Consumer Guarantees Act 1993 and Fair Trading Act 1986. Business use alone does not exclude statutory protections; any lawful contracting out must meet the applicable legal requirements and be separately agreed in writing.
11Intellectual Property
The Customer warrants that all files, drawings, and designs supplied to LaserFab are owned by the Customer or that the Customer holds the necessary rights to have them manufactured. The Customer indemnifies LaserFab against any claims arising from infringement of third-party intellectual property rights.
LaserFab retains all intellectual property in its manufacturing processes, tooling, templates, and internal documentation. No rights to LaserFab's processes are transferred by the supply of goods.
12Privacy and Communications
LaserFab collects, uses, stores and protects personal information in accordance with its Privacy Policy and the New Zealand Privacy Act 2020. The Privacy Policy explains what information is collected, how it is used, who it may be shared with, retention, and how individuals may request access or correction.
LaserFab does not sell or share personal information with third parties for marketing purposes. You may request access to or correction of your personal information by contacting us using the details in section 15.
We send communications needed to respond to your enquiry or manage your order. Submitting a form does not subscribe you to promotional emails. Any marketing must have a lawful consent basis and include a way to unsubscribe.
13Trade Account Customers
Approved trade account customers are additionally subject to the terms and conditions set out in their signed trade account application and any credit arrangement confirmed in writing by LaserFab at the time of account approval.
Trade account credit limits, payment terms, and account-specific conditions are confirmed separately in writing. In the event of any inconsistency between these general Terms and the trade account terms, the trade account terms will prevail for matters specific to the credit arrangement.
LaserFab reserves the right to vary, suspend, or withdraw trade account facilities at its discretion, including where an account is overdue or where the Customer's financial position materially changes.
